December 2024 – Suspension of Enforcement of Payment Order and Writ of Execution for the Amount of €50,000

Lack of Written Evidence/Violation of Related Rules

By virtue of judgment no. 5064/2024 of the Single-Member Court of First Instance of Athens (Interim Measures Procedure), our application for the suspension of the enforcement of a Payment Order and the corresponding Writ of Execution, issued by a Servicer company in the amount of €50,000, was granted. The suspension was based on the likelihood of success of the first and second grounds of our appeal, which concerned the lack of written evidence and the violation of related procedural rules for initiating the process of compulsory enforcement against our clients.

Furthermore, the judgment indicated the likelihood of irreparable harm to our clients, as the continuation of enforcement would render the commercial activities of the principal debtor company impossible and jeopardize the financial interests of the individual guarantors.

Pursuant to the judgment, the enforcing party was temporarily prohibited, until the issuance of a final decision on our appeal (scheduled for hearing in February 2032), from proceeding with acts of compulsory enforcement (such as seizure and auction of real estate, bank account garnishments, etc.) against our clients, a commercial enterprise, and its legal representatives (acting as guarantors under the relevant agreements).
