October 2024 – Annulment of Payment Order of € 49,289.00 (plus interest)

Decision No. 9405/2024 of the Single-Member Court of First Instance of Athens (Special Procedure for Property Disputes) was issued, canceling Payment Order of €49,289.00 (plus interest), issued by the creditor company. At the same time, court costs of €1,000 were awarded in favor of our client.

With our motion we claimed and the court accepted that the issued payment order was invalid for the reason that the copy of the payment order that was served to us did not include the name of the judge of the Single Member Court of First Instance of Athens who had it issued, but only his initials had been set.

Furthermore, the court accepted our claim that the above deficiency caused our objector-principal procedural harm, as the latter, not knowing which judge issued the contested payment order, was deprived of the right to request an exception of said judge in her trial, in the event that it would be the same person.
