November 2023 – Condemnation of opposing parties for the crimes of false accusation, false testimony, and defamation
A condemning decision was issued against the opposing parties for the crimes of false accusation, false testimony, and defamation.
The former spouse of our client filed a case against him, alleging the commission of domestic violence, and criminal prosecution was initiated against him. However, during the hearing at the competent Court, our counterclaims challenging the charges were accepted, and it was ultimately proven that our client did not commit the alleged crime. He was acquitted by an irrevocable decision of the competent Court (you can find more informaition here).
Subsequently, our client filed a lawsuit against his ex-wife and her father, specifically because the former falsely accused him of the aforementioned crime, and both were charged with false testimony and defamation, both individually and in complicity, for the lies they presented before the competent investigative authorities and later before the Court during the trial of the former spouse.
The accused, as proven during the hearing process and acknowledged by the Court, intentionally committed the above crimes. It was established that the first accused, with intent, falsely accused our client, and both provided false incidents in their testimonies, knowing the falsehood of these incidents. These actions damaged his honor and reputation, and cast doubt on his personal and social worth. These claims became known to third parties.
Therefore, the Court sentenced them to a total imprisonment of 8 months for the first accused, the former spouse, and 5 months for the second accused, her father.
