October 2026 – Application for Interim Order granted – Suspension of the provisionally enforceable part of the decision on child maintenance

On 23.10.2026, the Athens Single-Member Court of Appeal granted our client’s application for an interim order (προσωρινή διαταγή) – he is the father of a minor child – against the opposing party, the mother. The application sought to suspend the provisionally enforceable part of the first-instance decision that obliged our client to contribute to the child’s maintenance.

More specifically, in July, the Athens Single-Member Court of First Instance issued final decision No. 1350/2026 on the competing actions filed by the parents, which concerned the custody, contact and maintenance arrangements for their child, who is 9.5 years old. However, that decision was issued in the father’s absence, after the court rejected a postponement request he raised during the hearing of the competing actions. Against this default decision, he lodged an appeal, which was clearly lawful and timely, seeking annulment or, alternatively, reform of the first-instance judgment. However, the first-instance decision had been declared provisionally enforceable as regards the maintenance obligation, requiring our client-father to pay the opposing party, as his contribution to the child’s maintenance, the sum of €450.00 per month, instead of the €200.00 he had been paying until then.

When hearing our client-father’s application for suspension, the Court found his grounds of appeal likely to succeed. For this reason, it ordered the suspension of the enforceability of the above default decision in accordance with Article 913 of the Code of Civil Procedure, to the extent of the amount exceeding €200.00. Specifically, it suspended €250.00 of the total €450.00 declared provisionally enforceable. As a result, the applicant-father will continue to pay the maintenance amount he had been paying until now, until the hearing of his appeal, when the court will for the first time substantively assess the parties’ actual financial means and award the maintenance amount attributable to each parent.
